As part of state’s common law or statutory scheme, the judiciary may consider the legislative intent of the legislature when interpreting the law. Discerning the legislative intent of a bill is no easy task, as the bill must be located, and numerous sources must be uncovered, examined, and analyzed to try and figure out the exact aim of a legislature when enacting a new law.
While courts may be slow to accept this type of evidence at first, when prepared correctly, the intent of the legislature may just be the best weapon in our arsenal.
Join co-founder of Legislative Intent Services, Tom Stallard, as he walks through his involvement as an expert witness in the Rodney King case, and details how a bill from 1800’s was dusted off to create the bedrock of environmental law, The Public Trust Doctrine, in a landmark case that saved Mono Lake.
About Tom Stallard
Tom Stallard is a graduate of King Hall, the UC Davis School of Law, and is a member of the California Bar. He has been a U.S. Naval Officer, twice elected county supervisor, and former consultant in the California State Legislature. He is a founding trustee of the California State Library Foundation and the California State Archives Foundation. He has qualified numerous times as an expert witness on the subject of legislative intent, having co-founded Legislative Intent Service, Inc. in 1974. He has served on numerous public non-profit boards including public television station KVIE, Sacramento Metro Chamber of Commerce, Valley Vision, and The Great Valley Center. He is the Chair of the Cleaner Air Partnership and is past president of the King Hall Alumni Association.
