Cynthia M. Jones of Avatar Legal provides a comprehensive review of important considerations before filing your client’s trademark application. Ms. Jones first analyzes the marks that qualify for trademark protection and then discusses the rights conveyed by state and federal registration, strong and weak marks, the registration process, and current trends in trademark law.

Other topics discussed include common law trademark rights, the benefits of federal registration, actual use vs. intent to use, the principal and secondary register, enforcement & abandonment, domain names, Google Adwords and likelihood of confusion claims, and the effects of the Internet on trademark law.
